Terms of Service

1. Acceptance of Terms

By accessing and using CertLand.net (the 'Service'), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use our Service.

These Terms of Service constitute a legally binding agreement between you ('User', 'you', or 'your') and CertLand ('we', 'us', or 'our').

2. Description of Service

CertLand provides online practice exams and study materials for professional certification preparation, including but not limited to AWS, Azure, CompTIA, and other technology certifications.

The Service is offered in two tiers:

• Basic (Free): Limited access to practice exams and study materials
• Premium: Unlimited access to all exams, detailed explanations, and ad-free experience

3. User Eligibility

You must be at least 13 years old (or 16 years old in the European Economic Area) to use this Service. By using the Service, you represent and warrant that you meet this age requirement.

If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

4. User Accounts and Responsibilities

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your information to keep it accurate
• Maintain the security and confidentiality of your password
• Not share your account credentials with others
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

5. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others, including intellectual property rights
• Copy, reproduce, distribute, or sell any exam content without permission
• Use automated systems, bots, or scrapers to access the Service
• Attempt to gain unauthorized access to our systems or networks
• Upload viruses, malware, or any harmful code
• Impersonate any person or entity or misrepresent your affiliation
• Harass, abuse, or harm other users
• Interfere with or disrupt the Service or servers
• Use the Service for any commercial purpose without our written consent

6. Intellectual Property Rights

All content on CertLand, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, is the property of CertLand or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes. This license does not include:

• Any resale or commercial use of the Service or its contents
• Any collection and use of product listings, descriptions, or prices
• Any derivative use of the Service or its contents
• Any downloading or copying of account information for the benefit of another merchant

7. Educational Disclaimer

CertLand practice exams and study materials are for educational and preparation purposes only. We do not guarantee that using our Service will result in passing any certification exam.

CertLand is not affiliated with, endorsed by, or sponsored by any certification provider or exam board, including but not limited to:

• Amazon Web Services (AWS)
• Microsoft Azure
• CompTIA
• Or any other certification authority mentioned on our platform

All trademarks are the property of their respective owners. Use of these names does not imply endorsement.

8. Subscriptions and Payments

Premium Subscriptions

Premium subscriptions are offered in two billing cycles:

• Monthly: Charged every 30 days. Provides full flexibility to cancel before the next billing date.
• Annual: Charged once per year (currently $39.90/year). Offers a 33% discount compared to the monthly plan.

By subscribing, you authorize us to charge your payment method on a recurring basis at the frequency corresponding to your chosen plan.

7-Day Free Trial

All new Premium subscribers receive a 7-day free trial period. During this trial, no charge is applied to your payment method. Your first charge occurs on day 8 of the subscription, unless you cancel before that date.

If you cancel before the end of the 7-day trial period, your access will end and you will not be charged at all. The free trial is available once per user account.

Automatic Renewal

Your subscription will automatically renew at the end of each billing period (monthly or annual, depending on your plan) unless you cancel before the renewal date. You will be charged the then-current rate for your subscription plan.

Cancellation Policy

You may cancel your subscription renewal at any time through your account settings. The specific effect of cancellation depends on your billing cycle:

• Monthly plan: Cancelling stops the next monthly charge. You retain full Premium access until the end of your current billing month. No partial-month refunds are issued.
• Annual plan: Cancelling stops the automatic annual renewal. You retain full Premium access for the entire year you have already paid for. No prorated refund is issued for the unused portion of the annual period once the 7-day free trial has ended.

In both cases, cancellation takes effect at the end of the current billing period; access is not terminated immediately upon cancellation.

Refund Policy

Because all plans include a 7-day free trial during which no charge is applied, we generally do not offer refunds after the trial period ends. Exceptions may be made at our sole discretion in cases of documented technical failure that prevented access to the Service. Refund requests must be submitted within 14 days of the charge in question by contacting support@certland.net.

Refunds are not available for renewal charges on either monthly or annual plans once the 7-day trial window has passed.

Price Changes

We reserve the right to change our subscription fees. Any price changes will be communicated to you at least 30 days in advance via email and will apply to subsequent billing periods only. Your current billing cycle will not be affected.

9. Third-Party Advertisements

Our Service may display third-party advertisements, including Google Ads. We do not control the content of these advertisements and are not responsible for the products or services advertised.

Premium subscribers enjoy an ad-free experience. Basic (free) users may see advertisements as part of the Service.

10. Limitation of Liability

To the maximum extent permitted by law, CertLand shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use of or inability to use the Service
• Any unauthorized access to or use of our servers and/or personal information
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, or malware transmitted through the Service
• Any errors or omissions in any content or for any loss or damage incurred from use of content
• Results of any certification exams taken after using our Service

11. Warranty Disclaimer

THE SERVICE IS PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that defects will be corrected. We do not warrant the accuracy, reliability, or completeness of any content.

12. Indemnification

You agree to defend, indemnify, and hold harmless CertLand and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another.

13. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so by contacting us or using the account deletion feature.

All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws applicable in your jurisdiction, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved through good faith negotiations. If negotiations fail, disputes may be subject to binding arbitration or the exclusive jurisdiction of courts in your jurisdiction, as applicable.

15. Changes to Terms of Service

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

Your continued use of the Service after changes are posted constitutes your acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Service.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will continue to be valid and enforceable to the fullest extent permitted by law.

17. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and CertLand concerning the Service.
